Welcome to Mixolog! These Terms and Conditions ("Terms") govern your use of the Mixolog cocktail mixology application ("Service"). By accessing or using Mixolog, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old (or 21 years old where required by local law) to consume alcohol. By using the Service, you represent and warrant that you meet the age requirements of your jurisdiction. Mixolog does not sell or deliver alcohol and is not responsible for your consumption of alcoholic beverages.

3. Account Registration

• You may only create one account per individual.
• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• We employ systems to detect and prevent multiple account creation. Violations may result in account suspension or termination without refund.

4. Service Description

Mixolog provides:

• AI-powered cocktail recipe generation
• Tools to create and manage cocktail recipes, ingredients, and glassware
• Personalized taste profiles
• Free and paid subscription plans with varying AI token allocations and features

4.1 Free Tier

• Access to all core features with usage limits
• Limited AI generation tokens per billing cycle
• Cocktails are public by default

4.2 Paid Plans

• Increased AI token allocations
• Some plans include private cocktail storage
• Additional features as described on our pricing page

5. AI Tokens and Usage

• AI tokens are consumed when using AI-powered features.
• Token consumption varies based on third-party provider pricing and is not guaranteed to be consistent across requests.
• Token usage is transparent and always visible within the application.
• Tokens reset monthly on your billing cycle date and do not carry over to the next cycle.
• There is currently no option to purchase additional tokens. If you exhaust your tokens, you must wait until the next billing cycle.
• If the Service experiences extended downtime affecting your token usage, you may contact [email protected] for a pro-rated refund or token credit.

6. Payments and Billing

• Payments are processed through Stripe.
• Subscription fees are billed monthly on your billing cycle date.
• All prices are subject to change with notice.
• By subscribing, you authorize us to charge your payment method on a recurring basis.

Plan Changes

• Upgrades take effect immediately, and you will be charged a pro-rated amount for the remainder of the billing cycle.
• Downgrades take effect at the start of the next billing cycle.

7. Refund Policy

• You may request a refund within 14 days of your initial subscription or renewal.
• Refunds are only available if you have used fewer than 500 AI tokens during the billing period.
• Heavy usage of the Service may disqualify you from receiving a refund.
• To request a refund, contact [email protected] with your account details and reason for the request.
• Refunds are granted at Mixolog's sole discretion and are not guaranteed.

8. Content Ownership and License

Your Content

• You retain ownership of all content you create, including cocktail recipes, taste profiles, and other data.
• By using the Service, you grant Mixolog a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving the Service.
• Public content may be visible to other users and may be used by Mixolog for promotional purposes.

Personal Information

• Your personal information (e.g., email, name) is governed by our Privacy Policy.
• You may request deletion of your personal information by deleting your account or contacting [email protected].
• We retain personal information only as long as necessary to provide the Service or as required by law.

Commercial Use

• You may use AI-generated and manually created content for commercial purposes.
• You do not have exclusive rights to any content. Mixolog and other users may also use, modify, or sell content created within the Service.

9. AI-Generated Content Disclaimer

• AI-generated cocktail recipes are provided for informational and entertainment purposes only.
• You are solely responsible for any cocktails you create or consume based on AI-generated content.
• Mixolog makes no guarantees regarding the accuracy, safety, taste, or suitability of AI-generated recipes.
• Taste profiles (likes/dislikes) are used to guide AI responses but do not guarantee exclusion of specific ingredients.
• Allergen Warning: Do not rely on taste profiles or AI suggestions to avoid allergens. Always verify ingredients yourself.
• Mixolog is not liable for any illness, injury, or adverse effects resulting from cocktails created using the Service.

10. Acceptable Use Policy

You agree not to use the Service to:

• Create, generate, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Generate content related to terrorism, pornography, violence, hate speech, or other inhumane activities.
• Violate any local, national, or international law.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the Service or servers.
• Attempt to gain unauthorized access to any part of the Service.

Violations will result in immediate account termination without refund.

11. Account Termination

By You

• You may delete your account at any time through the application or by contacting [email protected].
• Account deletion is subject to our refund policy (Section 7).

By Mixolog

• We reserve the right to suspend or terminate your account at any time for violations of these Terms, including but not limited to: Creating multiple accounts, Generating unacceptable content, Abusing the Service or engaging in fraudulent activity
• Termination for violations will result in no refund of subscription fees.

12. Service Availability

• The Service is provided "as is" and may be subject to interruptions, errors, or downtime.
• We do not guarantee uninterrupted or error-free access to the Service.
• We may perform maintenance or updates that temporarily affect availability.
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

13. Limitation of Liability

To the fullest extent permitted by law:

• Mixolog is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• This includes, but is not limited to, damages arising from: Use of AI-generated content, Loss of data or content, Service interruptions or errors, Unauthorized access to your account
• Our total liability to you for any claims arising from the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

14. Disclaimer of Warranties

• The Service is provided "as is" and "as available" without any warranties of any kind.
• All warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, are disclaimed.
• We do not warrant that the Service will be uninterrupted, error-free, or secure.

15. Indemnification

You agree to indemnify, defend, and hold harmless Mixolog, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your infringement of any third-party rights.
• Any content you create, upload, or share through the Service.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Kingdom. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of the United Kingdom.

17. Changes to Terms

• We reserve the right to modify these Terms at any time.
• Changes will be effective immediately upon posting to the Service.
• Your continued use of the Service after changes constitutes acceptance of the modified Terms.
• We encourage you to review these Terms periodically.

18. Changes to Service and Pricing

• Mixolog reserves the right to change features, functionality, pricing, and subscription plans at any time.
• We will provide notice of material changes where reasonably possible.
• Continued use of the Service after changes constitutes acceptance.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mixolog regarding the Service and supersede all prior agreements.
